1. About us Backwash Vintage is an online store based in Portugal, specialising in second-hand, vintage and pre-owned surf and skate clothing and accessories. Email: backwashvtg@gmail.com · www.backwashvtg.com
2. Acceptance of terms By accessing or purchasing from our store, you agree to these Terms of Service. If you do not agree, please do not use our store.
3. Products All items are second-hand, vintage or pre-owned unless expressly described as deadstock (unworn). Each item is unique and sold as described. We make every effort to accurately describe and photograph each piece, including visible signs of wear or ageing. By purchasing, you acknowledge the pre-owned nature of the items.
4. Pricing & payment Prices are shown in your selected currency and include applicable taxes. We accept the payment methods shown at checkout. We reserve the right to change prices at any time without prior notice.
5. Orders By placing an order you make an offer to purchase the item. We reserve the right to cancel any order due to pricing errors, stock issues or suspected fraud. You will be notified and fully refunded if your order is cancelled.
6. Shipping All orders ship from Portugal. Delivery times are estimates and not guaranteed. See our Shipping Policy for details.
7. Returns & refunds Returns are governed by our Return & Refund Policy, which forms part of these Terms. The statutory 14-day right of withdrawal applies to EU and UK customers; orders to other regions are final sale except where an item is faulty or not as described. All return shipping costs are the customer's responsibility.
8. Legal guarantee Used goods carry an 18-month legal guarantee of conformity from delivery, under Decreto-Lei n.º 84/2021. This right cannot be excluded.
9. Intellectual property All content on this store (photos, text, branding) is the property of Backwash VTG and may not be reproduced without written permission.
10. Limitation of liability To the extent permitted by law, Backwash VTG is not liable for indirect, incidental or consequential damages arising from use of the store or products. Our liability is limited to the value of the order placed. Nothing in these Terms limits your mandatory statutory rights as a consumer.
11. Alternative dispute resolution (ADR / RAL) If we cannot resolve a complaint directly, EU consumers may refer the dispute to a certified alternative dispute resolution body. In Portugal, the residual national entity is CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt); a consumer may also use the entity competent for their area. 12. Governing law These Terms are governed by the laws of Portugal, without prejudice to the mandatory consumer-protection rules of the consumer's country of residence. Portuguese courts have jurisdiction, subject to any consumer right to bring proceedings in their own country.
13. Changes to terms We may update these Terms at any time. Changes are posted on this page with an updated date.
